ToxicNearMe is operated by Retrogram Music, LLC. References to "ToxicNearMe," "we," "us," and "our" mean Retrogram Music, LLC and the ToxicNearMe service.

Beta status

ToxicNearMe is a beta product. The service, data ingestion, matching, geocoding, ranking, labeling, source links, and display logic may contain errors. Source records may also be incomplete, delayed, approximate, revised, or wrong. You should double-check every important result against the official source before relying on it.

Beta access is provided for testing, feedback, and general informational review. Do not use ToxicNearMe as the sole basis for health, property, legal, financial, relocation, emergency, or safety decisions.

Public-record screening only

ToxicNearMe summarizes public environmental records from government and related public datasets. Reports are informational screening materials only. They are not environmental, engineering, legal, health, real estate, insurance, financial, or emergency advice.

A report does not determine whether a property, business, city, water system, or person has been exposed to any substance. It also does not determine whether environmental conditions are absent. Use official agency records and qualified professionals before making health, property, legal, financial, relocation, or safety-related decisions.

Data limitations

Source data may be incomplete, delayed, approximate, incorrectly geocoded, modeled, self-reported, or matched by city, ZIP code, county, census block, watershed, radius, or other non-parcel methods. Some records may describe historical conditions, resolved issues, candidate service areas, modeled estimates, or regulatory context rather than current conditions at a specific address.

We may rank, group, summarize, filter, or label records to make public data easier to review. Those labels are ToxicNearMe's screening categories, not official agency determinations unless the report expressly says otherwise.

Corrections and data issues

If you believe a ToxicNearMe report displays inaccurate, stale, misleading, or wrongly matched information, please use the report a data issue page. We may review, annotate, suppress, or update app-derived information when appropriate. Errors in the underlying government source data may need to be corrected by the source agency.

No warranties

The service is provided "as is" and "as available." To the fullest extent allowed by law,Retrogram Music, LLC disclaims warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.

Limitation of liability

To the fullest extent allowed by law, Retrogram Music, LLC will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for decisions made in reliance on ToxicNearMe reports. This limitation applies even if we have been advised of the possibility of such damages.

Government sources and third-party links

Toxin Scout is not affiliated with, sponsored by, or endorsed by any government agency. This includes EPA, FEMA, CDC, NRC, PHMSA, MSHA, state agencies, local agencies, and other data providers. Links to official sources and third-party websites are provided for verification and convenience. We do not control those sites or their data.

User responsibilities

You agree not to use ToxicNearMe to harass, defame, threaten, discriminate against, or unfairly target any person, property owner, business, public agency, or community. You are responsible for independently verifying records before publishing, sharing, or acting on them.

Changes

We may update these terms or change the service at any time. Your continued use of ToxicNearMe after changes are posted means you accept the updated terms.
